Nielsen IP Law LLC represents companies in connection with the strategic procurement, licensing and enforcement of patent rights, having a special expertise in chemical, pharmaceutical, biotechnology, medical device and life sciences industries.  As part of the due diligence process, we work with investors or acquiring companies to assess the patent assets and liabilities of the target company.  To ensure a successful new product or process launch, we work with the engineers and scientist, and members of the company’s management team to landscape, assess and confirm freedom to operate. Our patent procurement services include investigating and assessing patentability of new technologies, drafting and prosecuting patent applications, and developing strategies for maximizing the benefit of a patent portfolio.  In addition to having technical degrees, what sets us apart from many other intellectual property firms is most of us have had previously worked as an engineer or scientist within his or her respective fields.



Our trademark practice focuses on the protection of our clients' trademark rights in the US and throughout the worldwide, when needed.  In the United States, trademarks and service marks include a word, name, symbol, or design, or combination thereof, used in commerce to identify and distinguish the goods of one manufacturer or seller from those of another and to indicate the source of the goods.

Trademarks and services marks include trade dress, color and sound, and are protected under the common law or by acquiring state and/or federal trademark rights.  Consequently, an extensive trademark search and analysis can be complicated, but often this is the most necessary step in adopting a business name or logo.  Through the use of our reliable resources, our firm can obtain an extensive search in a matter of days, and shortly thereafter provide a very through and detailed review analysis, providing a high level of confidence and low level of risk in the outcome of our findings and conclusions.

Federal applications for US trademark registration are filed electronically and can often be filed on the same day requested, if necessary.  We also represent clients before the Trademark Trial and Appeal Board in inter partes actions including opposition and cancellation proceedings, and in licensing and trade dress matters.

Through the use of watching services and/or private investigations, infringers and counterfeiters can be found at an early stage to prevent the pirating of valuable intellectual property rights, both in the U.S. and abroad. 



Generally, a trade secret means and includes information that derives independent economic value from not being generally known to other persons who can obtain economic value from its disclosure or use.  A trade secret can be just about any type of information including formulas, patterns, compilations, programs, devices, methodology, techniques, or processes.  This information, however, must be the subject of efforts that are reasonable under the circumstances to maintain its secrecy. 


A trade secret is a unique type of intellectual property right because a right in and to a trade secret right can be perpetual - provided the proper measures are implemented and maintained.  We regularly advise clients on how to protect against the theft of their confidential information from both external and internal threats and can help with the implementation of a trade secret protection program.  As part of this, we often prepare confidentiality agreements and work with lawyers who specialize in labor law to procure employee agreements having enforceable restrictive covenants (e.g., non-competition, non-solicitation, and non-disclosure agreements). 


Today’s global economy makes it critical to tailor the appropriate restrictive covenants under laws which vary widely by state and international jurisdictions.  Also, in litigation over misappropriation of trade secrets, the stakes are high.  So, we employ and work with top litigation firms to protect and enforce client’s trade secrets, and to defend them against baseless allegations of misappropriation.
